Marigig Terms of Use

Effective Date: March 2026

Welcome to Marigig – a platform designed to empower freelancers, solopreneurs, and service-based businesses. These Terms of Use ("Terms") govern your access and use of the Marigig platform, including its websites, applications, and related tools ("Platform"). The Platform is operated by Marigig Sdn Bhd. By accessing or using Marigig, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

1. Definitions

  • Platform means Marigig and all its digital services, including websites, applications, and systems operated by Marigig Sdn Bhd.
  • Member means any individual (freelancer, self-employed professional) or registered business that has created an account on the Platform.
  • Buyer means any user seeking services or information from Sellers via the Platform.
  • Seller means any Member who has upgraded to a Seller role and offers services or products via the Platform, subject to an active or trial subscription where applicable.
  • Account means the registered Member's login and identity on the Platform.
  • Subscription means the agreement to access a paid plan (e.g. Business, Elite or other plan types) for a defined period, including any trial period.
  • Trial means a period during which a Seller may use plan features without payment, as configured by the Platform; eligibility and duration are determined by the Platform and may vary by plan.
  • Plan means a subscription tier that defines quotas (e.g. number of listings, boosts) and features available to the Member.
  • Listing or Post means any service listing, advertisement, or content published by a Seller on the Platform.
  • Boost means a feature that increases visibility of a Listing (e.g. featured or premium placement) within the limits of the Member's plan.
  • Contact Reveal means the Platform feature that allows Buyers to view or access a Seller's contact information (e.g. phone number) subject to tiered limits and rules set by the Platform.
  • Content means any text, image, video, link, or other material that Members upload, post, or transmit through the Platform.

2. Member Registration

2.1 All Members must provide complete, current, and truthful information when registering, including:

  • For individuals: valid identification (e.g. MyKad, passport) where required
  • For businesses: business registration (e.g. SSM) where required
  • Accurate contact, email, and payout details (e.g. bank or eWallet) where applicable

2.2 Marigig reserves the right to request further verification (including identity or compliance checks) at any time. Refusal or failure to comply may result in restriction or termination of your Account.

2.3 The Platform may approve, reject, suspend, or remove an Account at its discretion and is not obliged to provide a reason.

2.4 By registering, you confirm that all information submitted is accurate and agree to be liable for any loss or damage caused by misrepresentation or breach of these Terms.

3. Account Usage Rules

  • 3.1 Each Account is personal and non-transferable. You may not share, sell, rent, or transfer access without Marigig's prior written consent.
  • 3.2 You must keep your login credentials secure and are responsible for all activity under your Account.
  • 3.3 Payments to or from you (where applicable) must use the verified bank or eWallet accounts linked to your Account.
  • 3.4 Marigig may monitor activity, restrict features, or suspend Accounts where it reasonably suspects breach of these Terms or misuse of the Platform.
  • 3.5 Upon registration, your role defaults to Buyer. You may become a Seller by completing the onboarding process and, where required, selecting and maintaining a valid Subscription (including Trial) in accordance with the then-current plan terms.

4. Subscriptions and Billing

4.1 Plan and Trial

  • Seller plans (e.g. Business, Elite) and any Trial are offered at the Platform's discretion. Eligibility for Trial, free days, and plan features may vary and are subject to change.
  • Quotas (e.g. number of Listings, Boosts per month) are determined by your Plan and version at the time of subscription. Daily and monthly limits reset automatically; unused quotas do not roll over.
  • You must comply with plan-specific terms (including any on-screen legal confirmation) when subscribing. By completing subscription or Trial activation, you agree to the applicable plan terms.

4.2 Renewal and Billing

  • Where a plan has automatic renewal or instalment billing, you authorise the Platform (or its payment partner) to charge the payment method on file on the scheduled billing dates until the subscription is cancelled or fully paid.
  • You are responsible for ensuring your payment method is valid and sufficient. Failure to pay may result in suspension or termination of your Subscription and access to plan features.

4.3 Cancellation and Expiry

  • You may cancel your Subscription in accordance with the options provided on the Platform. Cancellation may take effect at the end of the current billing period or as otherwise stated.
  • On expiry or cancellation, your access to plan-specific features (e.g. extra Listings, Boosts) will end. Content already published may remain subject to these Terms and Platform policies (e.g. removal or downgrade of visibility).

4.4 No Refund

  • Unless otherwise required by law or expressly stated in writing by Marigig, fees paid for Subscriptions (including any partial billing period) are non-refundable. This includes unused Trial conversion, partial months, or Boosts already consumed.

4.5 Changes to Plans and Pricing

  • Marigig may change plan features, quotas, pricing, or Trial terms. Changes to existing Subscriptions will be applied as described at the time of the change (e.g. on next renewal). Continued use after notice of changes constitutes acceptance.

5. Listings and User Content

5.1 Creation and Limits

  • Listings must comply with these Terms and any content or listing policies published on the Platform. You may only publish Listings within the daily and total limits of your current Plan.
  • Listings may expire (e.g. after a fixed period for certain plans). It is your responsibility to manage your Listings within the rules and limits displayed to you.

5.2 Boosts

  • Boost features (e.g. featured or premium placement) are subject to your plan quotas and duration limits. Use of a Boost counts against your quota even if the Listing is later removed or expires. Marigig does not guarantee any particular placement, traffic, or business result.

5.3 Content Ownership & Platform Usage Rights

You retain ownership of all Content you submit, including text, images, videos, and business information.

By posting Content on Marigig, you grant Marigig a non-exclusive, worldwide, royalty-free, perpetual licence to:

  • display, publish, and distribute your Content on the Platform;
  • promote your Content across Marigig channels;
  • use your Content to improve search, matching, and recommendation systems; and
  • retain and display your Content even if your Subscription becomes inactive or expires.

This helps maintain customer experience, search consistency, and platform integrity.

  • You may remove your Content at any time through your Account. However, previously shared or distributed copies may continue to exist for system integrity, analytics, or historical reference.
  • Marigig does not claim ownership of your business or services.

5.4 Content Retention & Visibility

  • To maintain a consistent user experience, Marigig may continue to display previously published Content even if a Seller's Subscription has expired.
  • However, certain features (such as direct contact options) may be limited or disabled depending on the Seller's account status.

5.5 Additional Distribution & Promotion Rights

To help Sellers gain visibility and customers, Marigig may distribute or allow the distribution of Content beyond the Platform, including through:

  • social media sharing (e.g. Facebook, TikTok, WhatsApp);
  • paid or organic marketing campaigns; and
  • partner, affiliate, or referral programmes.
  • Such distribution may be performed by Marigig or by third parties authorised by Marigig.
  • Where applicable, Content may be shared together with tracking links or referral mechanisms that allow partners to earn incentives for promoting Marigig.
  • Marigig and its partners may adapt formatting for distribution purposes, but will not misrepresent the Seller's services or create misleading claims.

5.6 Seller Content Responsibility

In plain terms: if you upload or publish photos, videos, music, or other materials without the necessary rights or permissions, you bear sole responsibility for any dispute, claim, or loss arising from that use; Marigig is not liable for such matters and does not assume joint or several liability with you.

  • You are responsible for ensuring that all Content you submit is accurate, lawful, and does not infringe any third-party rights, including copyrights, trademarks, or personal data.
  • You are solely responsible for the appropriateness of your Content. You represent that you have the right to publish the Content. Marigig is not liable for any claim arising from your Content.
  • Marigig reserves the right to remove or restrict Content that violates these Terms or may harm users, the Platform, or third parties. Marigig may moderate, hide, or remove any Content (including Listings) that it reasonably believes violates these Terms, the law, or third-party rights, or is harmful to the Platform or users. We may use automated tools and human review. We are not obliged to restore removed Content.

6. Contact and Phone Reveal

6.1 The Platform may provide a Contact Reveal feature so that Buyers can view or access a Seller's contact information (e.g. phone number) for the purpose of contacting the Seller. Access may be subject to tiered limits (e.g. per user per Seller per day), verification steps, or other rules as displayed on the Platform.

6.2 Marigig only facilitates the reveal of contact information that Sellers have chosen to display. Marigig is not a party to any communication or transaction that takes place off the Platform (e.g. by phone, WhatsApp, or email).

6.3 Buyers must use revealed contact information only for legitimate enquiries related to the Seller's services. Misuse (e.g. harassment, spam, fraud) is prohibited and may result in suspension or legal action. Sellers are responsible for any consequences of sharing their contact details.

6.4 Marigig shall not be liable for any loss, dispute, or harm arising from contact or transactions conducted outside the Platform after contact information has been revealed.

7. Acceptable Use & Prohibited Conduct

7.1 You must not:

  • Register or use the Platform with fake, stolen, or misleading identity or information
  • Use the Platform for any illegal, deceptive, or harmful purpose
  • Harass, scam, or exploit other users, or misuse reviews or reporting features
  • Circumvent Platform rules, limits, or security (e.g. creating multiple accounts to evade restrictions)
  • Scrape, automate access, or overload the Platform without authorisation
  • Post Content that is false, defamatory, infringing, obscene, or that incites violence or discrimination

7.2 Marigig has zero tolerance for misconduct and may take corrective action (including suspension or termination of Account and removal of Content) without prior notice where it reasonably believes these Terms have been breached.

8. Platform Role & Responsibilities

  • 8.1 Marigig acts solely as a listing and matching platform. It is not a party to any agreement, transaction, or communication between Buyers and Sellers.
  • 8.2 The Platform does not guarantee the safety, legality, reliability, or quality of any service, Listing, or Content. Users must conduct their own due diligence.
  • 8.3 While Marigig implements reasonable security measures, it cannot guarantee uninterrupted or error-free operation or full protection against data breaches or misuse.
  • 8.4 You agree to indemnify and hold Marigig, its affiliates, and their officers, directors, and employees harmless from any third-party claims, damages, or costs (including reasonable legal fees) arising from your use of the Platform, your Content, or your breach of these Terms.

9. Payment Disclaimer & Off-Platform Transactions

9.1 Marigig is not a payment intermediary between Buyers and Sellers. Payments between Buyers and Sellers are conducted directly using their chosen methods (e.g. bank transfer, FPX, card, eWallet). The Platform does not collect, hold, or transfer user funds for B2B or B2C transactions between users.

9.2 Subscription fees (for Plans) are paid to Marigig or its designated payment provider. Those payments are governed by these Terms and the plan terms. Off-platform payments between users are entirely at their own risk.

9.3 The Platform may provide tools (e.g. invoices, payment confirmation links) to help users log transactions. Marigig does not facilitate, guarantee, or take responsibility for the completion or legality of any payment made outside the Platform.

9.4 Marigig shall not be liable for failed, delayed, fraudulent, or misdirected payments between users, or for any dispute arising from such payments.

9.5 Online Payment for Subscriptions (Card / Online Banking / eWallet)
Marigig uses third-party payment service providers (for example, card processors, FPX gateways or eWallet providers) to process subscription fees (including after any Trial period). By submitting your card or payment details, you authorise Marigig and its payment partners to process payments in accordance with your selected plan and billing schedule.

9.6 Authorisation and Recurring Charges
By subscribing to a paid plan, you authorise Marigig to store and use your payment method for current and future subscription charges (including instalments, renewals and any applicable taxes or fees). Where your plan is on auto-renewal or instalment, you expressly consent to recurring charges to your payment method until you cancel in accordance with these Terms or the subscription is fully paid.

9.7 No Refund / No Chargeback Abuse
Except where required by law or expressly stated in writing by Marigig, all subscription fees are non-refundable and non-creditable, including any partially used billing periods, unused quotas, or unconsumed Trial. You agree not to intentionally initiate chargebacks or payment disputes without a valid legal basis. If you do so, Marigig may suspend or terminate your account and may seek recovery of any amounts, chargeback fees, penalties or related costs (including reasonable legal fees) from you.

9.8 Payment Failures and Suspension
If a charge is declined, reversed, or a chargeback is received, Marigig may, at its discretion: (a) suspend or downgrade your subscription and access to paid features; (b) require you to update your payment method; and/or (c) terminate your subscription. You remain responsible for any outstanding amounts that were due before suspension or termination.

9.9 Currency, Taxes and Fees
All prices are shown in the currency indicated on the Platform (currently Malaysian Ringgit, unless stated otherwise) and exclude any applicable taxes, bank charges or currency conversion fees, unless clearly specified. You are solely responsible for any additional charges imposed by your bank, card issuer or payment provider (including foreign exchange fees).

9.10 Security and Liability
Marigig uses commercially reasonable measures and reputable payment providers to protect payment information. However, no method of transmission or storage is completely secure, and Marigig does not guarantee absolute security of payment data. To the fullest extent permitted by law, Marigig is not liable for any loss arising from unauthorised use of your card or payment method where such use is not caused directly by Marigig’s wilful misconduct or gross negligence.

9.11 Changes to Payment Methods
Marigig may add, remove, or change supported payment methods and payment partners at any time. Any change will apply to new payments after the change is implemented.

10. Compliance & Risk Allocation

10.1 Seller Legal Responsibility

  • Sellers must hold and maintain valid legal working rights (e.g. work permits, business licences) where required by law.
  • If Marigig reasonably believes a Member has violated laws or these Terms, it may suspend or terminate the Account and cooperate with relevant authorities.

10.2 Identity & Compliance Verification

  • Marigig may require Sellers to undergo identity or compliance verification (KYC), including via government or third-party providers (e.g. JPN, JTK, Experian, CTOS, Verihub). Refusal or failure may result in restriction or termination of the Account.

10.3 Reporting and Takedown

  • Users may report suspected violations via the Platform's reporting mechanism. Reported Content may be hidden pending review. Marigig may permanently remove Content or Accounts after investigation and is not obliged to disclose the outcome to the reporter or the subject.

10.4 Third-Party and Embedded Content

  • External media (e.g. embedded videos from other platforms) remain the property of their respective owners. Marigig acts only as a display layer and is not responsible for third-party content. Marigig may remove any Content that it reasonably believes is infringing or unlawful.

10.5 Advertising and Prohibited Content

Prohibited Content includes but is not limited to:

  • False or misleading endorsements (e.g. impersonating celebrities or public figures)
  • Unverified medical or therapeutic claims
  • Pornographic, obscene, or otherwise offensive material
  • Content that violates applicable law or public order

11. Account Violations & Enforcement

11.1 Marigig reserves the right to:

  • Suspend, restrict, or permanently ban Accounts that violate these Terms
  • Remove or hide Content without prior notice
  • Report suspected illegal activity to authorities and cooperate with investigations
  • Preserve or disclose data where required by law or to protect the Platform and users

11.2 You are responsible for all consequences resulting from your breach of these Terms, including loss of access, loss of Content, and any liability to third parties.

12. Disclaimer and Limitation of Liability

  • 12.1 Listing-Only Platform: Marigig is not a party to any transaction, service agreement, or payment between Members and their clients.
  • 12.2 No Verification Guarantee: We do not guarantee the truthfulness, accuracy, or completeness of any profile, Listing, or review. Users must perform their own due diligence.
  • 12.3 No Guarantee of Results: We do not guarantee any level of leads, jobs, income, exposure, or visibility (including from Boosts or Contact Reveal).
  • 12.4 No Liability for User Disputes or Losses: Marigig is not liable for any damage, loss, or dispute arising from (a) transactions or communications between users, (b) your Subscription, Trial, or use of plan features, (c) your Content or Listings, or (d) contact or dealings after Contact Reveal.
  • 12.5 Service Availability: We may modify, suspend, or discontinue any part of the Platform at any time. We are not liable for any unavailability or loss of data beyond our obligations under applicable law.
  • 12.6 Maximum Liability: To the fullest extent permitted by law, Marigig's aggregate liability to you for any claim arising from or related to these Terms or the Platform shall not exceed RM100 (Malaysian Ringgit one hundred).

13. Data and Privacy

13.1 Your use of the Platform involves the collection, use, disclosure, storage, and processing of personal data. Such processing is governed by our Privacy Policy, which forms part of these Terms.

13.2 By registering, logging in, subscribing, or otherwise using the Platform, you acknowledge that you have read and understood the Privacy Policy and consent to personal data processing in accordance with applicable law (including the Personal Data Protection Act, where applicable).

13.3 Where your consent is required for optional processing (for example, certain marketing or non-essential cookies), you may withdraw that consent as described in the Privacy Policy.

13.4 You agree to provide accurate, complete, and up-to-date personal data and to promptly update your information if it changes.

14. PDPA Compliance and User Data Rights

14.1 Marigig applies the core personal data protection principles of consent, notice and choice, limited disclosure, security safeguards, retention limits, data accuracy, and access/correction rights, as further described in the Privacy Policy.

14.2 You may submit requests to access, correct, or delete your personal data, subject to verification and lawful limitations. We may retain certain data where required or permitted by law, including for fraud prevention, dispute handling, accounting, tax, audit, and legal compliance.

14.3 We may use service providers and trusted partners to process data on our behalf under contractual confidentiality and data protection obligations.

14.4 If you believe your privacy rights have been infringed, you may contact us through the channels listed in the Privacy Policy and these Terms. We will investigate and respond in accordance with applicable law.

15. Changes to Terms

15.1 Marigig may update these Terms at any time. We will communicate material changes (e.g. by notice on the Platform or by email where appropriate). The "Effective Date" at the top of this page may be updated when changes take effect.

15.2 Continued use of the Platform after the effective date of changes constitutes your acceptance of the revised Terms. If you do not agree, you must stop using the Platform and may close your Account.

16. Termination

16.1 You may close your Account at any time through the options provided on the Platform, subject to any outstanding obligations (e.g. subscription period already paid).

16.2 Marigig may terminate or suspend your Account and access to the Platform if you breach these Terms or for any other reason at its discretion. On termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive (e.g. indemnity, limitation of liability, governing law) will survive termination.

17. Governing Law

These Terms are governed by the laws of Malaysia. Any dispute arising from or in connection with these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts of Malaysia.

18. Severability and Entire Agreement

18.1 If any part of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect.

18.2 These Terms, together with the Privacy Policy and any plan-specific terms you accept when subscribing, constitute the entire agreement between you and Marigig regarding the Platform and supersede any prior agreements or understandings.
